DUMPSTER RENTAL AGREEMENT
It is expressly understood and agreed that this is a contract of rental only, and that nothing contained in this agreement shall be construed as conveying to the Customer any right, title, or interest in the equipment, other than as a rental.
IN CONSIDERATION OF THE RENTAL FEES, THE CUSTOMER SHALL HAVE EXCLUSIVE USE OF AN OPEN TOP DUMPSTER CONTAINER FOR A PERIOD OF 14 DAYS. CUSTOMER MAY REQUEST A PERIOD LONGER THAN 14 DAYS, WITH THIS PERIOD SUBJECT TO ADDITIONAL FEES AS DESCRIBED BELOW. AFTER THE EXPIRATION OF THAT PERIOD, THE CUSTOMER MUST CONTACT WHITE LINE WASTE TO PICK UP THE DUMPSTER AND HAUL OFF ITS CONTENTS FOR DISPOSAL: FAILURE TO NOTIFY WHITE LINE WASTE THAT THE DUMPSTER IS READY FOR PICK UP MAY RESULT IN ADDITIONAL FEES AS DESCRIBED BELOW. CUSTOMER MAY REQUEST HAUL-OFF PRIOR TO THE EXPIRATION OF THE 14-DAY PERIOD; HOWEVER, RETURN OF THE DUMPSTER TO THE SITE AND SUBSEQUENT HAUL-OFFS WILL BE AT AN ADDITIONAL CHARGE.
CONTINUING AGREEMENT: This agreement between Customer and WHITE LINE WASTE or it’s assigns shall continue in force for all subsequent rentals, unless terminated by either party in writing.
Possible additional charges include:
OVER DAYS: $10.00 per day -Any days over 14-Day Rental Period.
DUMPSTER RELOCATION: WHITE LINE WASTE can move a dumpster upon request, however a $60.00 trip fee may apply. Dumpsters CAN NOT be moved by customers.
OVERWEIGHT: $57.00 per ton -For each ton over allowance; prorated.
DUMP and RETURN: Requesting that your load be dumped and returned within the 14-Day Rental Period will be subject to the full price of a new dumpster rental and the returned dumpster will be treated as a new rental.
FUEL SURCHARGE: Variable charge for customers located outside of city limits.
All terms are payable on or before receipt of services, unless otherwise stated or agreed upon. The initial payment shall include but no be limited to: state and local taxes, delivery, pick-up, 14Dumpster Rental in Northwest Arkansas into this – Photo Credit Eric Roth This Old House-day use period, and respective weight allowance.
CONTAMINATION: Customer assumes responsibility, financial or otherwise, for any and all waste materials deposited in the dumpster. The inclusion of any non-waste materials may result in additional charges to the Customer including but not limited to charges for landfill’s rejection of the waste material.
UNACCEPTABLE ITEMS: CUSTOMER AGREES NOT TO PUT THE FOLLOWING UNACCEPTABLE ITEMS IN DUMPSTER
Antifreeze or refrigerants
Batteries (any kind)
Herbicides and pesticides
Solvents or contaminated oils
Sealed barrels or tanks, compressed gas canisters
Petroleum contaminated soil
Lead paint chips
Motor Oil, Transmission/lubricating, hydraulic oil or oil filters.
Volatile or flammable Liquids
Medical or infectious Waste
Paint (except completely dried latex paint cans)
Large amounts of stone, concrete, masonry, or earth
Weapons or ammunition
Any other toxic waste as defined by local, county, state or federal regulations.
The term “hazardous material” shall include but not be limited to, any amount of waste listed or characterized as hazardous by the United States Environmental Protection Agency or any state agency pursuant to the Resource Conservation and Recovery Act of 1976, an enabled or applicable state law.
CUSTOMER AGREES TO GAIN PERMISSION TO PLACE THE FOLLOWING IN DUMPSTER:
Tires (handling fee applies)
Earth, stone, or tree stumps
Electronics (Computers, Printers, TV’s, Microwaves, etc… Handling fee applies)
DUMPSTERS ARE TO BE FILLED LEVEL WITH THE TOP EDGE OF THE DUMPSTER AND NOTHING CAN BE STICKING OUT OF THE TOP OF THE DUMPSTER.
DAMAGE: As customer, you are responsible for any damages to dumpster while at your location.
Customer agrees to provide proper care of roll off dumpster rental container and to return the roll off dumpster rental container in good working condition at end of the rental period. If the dumpster is damaged by Customer, their agents, or third parties while in the Customer’s care, Customer agrees to pay reasonable repairs to said dumpster.
DRIVEWAYS AND SURFACES: Customer warrants that any right of way provided by Customer for WHITE LINE WASTE ‘s equipment is sufficient to bear the weight of all equipment and vehicles reasonably required to perform the service herein contracted. WHITE LINE WASTE shall not be responsible for damage to any private driving surface, pavement or accompanying sub-surface of any route reasonably necessary to perform the service herein contracted and Customer assumes all liabilities for damage to driving surfaces, pavement or road surfaces and entire container placement site.
ACCESS: Customer agrees to provide clear access to the dumpster for the purpose of loading and unloading.
USE OF EQUIPMENT: Customer agrees not to overload (by weight or volume), move or alter the equipment, and shall use the equipment only for its proper and intended purpose.
POSSIBLE ADDITIONAL FEES:
CANCELLATION: Cancellations made less than 24 hours prior to the scheduled service date will be subject to a cancellation fee of $70.
UNACCEPTABLE ITEMS: If any unacceptable items (including but not limited to the “Unacceptable Items” listed above) are found at the landfill while emptying the dumpster you will be charged accordingly based on the landfill fee schedule, in addition to any fines levied.
OVERLOADED, or OVERWEIGHT DUMPSTER: An additional per pro-rated ton fee will be applied if weight exceeds the agreed tonnage allowance, and under no circumstances shall the overall weight exceed 8 tons. If in excess of 8 tons, an additional “excessive weight” surcharge of a minimum of $150 will result in addition to the agreed terms. WHITE LINE WASTE reserves the right to refuse to service any dumpster which exceeds fill and weight capacity or surpasses the weight restrictions for public roads and highways. In this event, the Customer is responsible for offloading excess material and may incur an attempted delivery/removal fee up to $70 should the driver have to reschedule a time to return to remove the container.
BLOCKED: Delivery and/or removal of the dumpster is at the discretion of the driver. If driver is unsuccessful in attempting to pick-up or drop-off a dumpster we may charge the customer a $70 fee for the following reasons: Cars or other items blocking our access to pick-up or drop-off, tree branches or low power lines, overloaded or overweight dumpster (pick-up), driveway is not accessible or parking lot is locked, or any other reason the area we are delivering to or picking up from is inaccessible.
PAYMENT AND BILLING: All payment is due upon receipt of Dumpster at the start of the agreed upon rental period. All refund or credit requests shall occur within 30 days of service completion. Any refunds or credits shall be at the sole discretion of WHITE LINE WASTE.
The undersigned agree(s) that in the event of default or that the account is placed with a collection agency for collection, he/she is responsible for reasonable attorney’s fees, miscellaneous costs of collection, collection agency fees, court costs, service charges and/or interest as allowed by law. WHITE LINE WASTE reserves the right to charge a fee no greater than that allowed by law on all Customer checks returned for insufficient funds.
For all amounts billed and not paid in advance, Customer shall make payment within ten (10) days after the date of an invoice from WHITE LINE WASTE . WHITE LINE WASTE may charge, and Customer agrees to pay, a late fee no greater than that allowed by law on balances not paid within ten (10) days of the date of the invoice. In the event that any payment is not made when due, WHITE LINE WASTE may terminate services, recover all past due payments and recover any equipment from the Customer. In the event that Customer does not respond to WHITE LINE WASTE ‘s good faith requests for a dumpster removal date, WHITE LINE WASTE may terminate the rental and have the dumpster removed promptly.
TERMINATION: WHITE LINE WASTE may terminate this agreement at any time for reasons of misuse or neglect of the dumpster and WHITE LINE WASTE reserves the right to remove a dumpster at any time.
LIABILITY: Customer agrees to indemnify, defend and hold harmless WHITE LINE WASTE and its members, managers, employees, agents, and their respective successors and assigns against all claims, damages, suits, penalties, fines and liabilities for injury or death to persons or loss or damage to property arising out of Customer’s use, operation or possession of the equipment, including allegations of WHITE LINE WASTE ‘s negligence.
EXCUSED PERFORMANCE: WHITE LINE WASTE shall not be liable for failure to perform due to circumstances or the significant threat of circumstances beyond its reasonable control, whether foreseeable or not, including, but not limited to strikes, labor trouble, riots, compliance with laws or government orders, acts of war or terrorism, inability to access container, fires, and acts of God and such failure shall not constitute a default under this Agreement.
AMENDMENT: No amendment, modification, termination or cancellation of this Lease shall be effective unless made in writing signed by each of the parties hereto.
BINDING EFFECT: This Agreement shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, personal representatives, successors, and assigns.
ENTIRE AGREEMENT: This contract shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this contract shall not be binding upon either party except to the extent incorporated in this Rental Agreement.
GOVERNING PROVISION: The laws of the State of Arkansas will govern this contract. In the event of breach of the Agreement by the Customer, the Customer shall pay all reasonable attorney’s fees and costs of WHITE LINE WASTE to enforce this Agreement.
SEVERABILITY: If any provision of this Agreement shall be held to be invalid, illegal or unenforceable by a court of competent jurisdiction, the remainder of the Agreement shall not be affected thereby, and each remaining provision shall be valid and enforceable to the fullest extent permitted by law.
